Terms of service

Version 2026-08-03. If you use docubend, this is what you are agreeing to.

Who you are dealing with

docubend is operated by Brevard Creek Labs, LLC, a North Carolina limited liability company. In everything below, “we”, “us” and “our” mean that company, and “you” means you — or, if you are using docubend for an organisation, that organisation, and you are telling us you are allowed to accept these terms for it.

What docubend is

A tool for working on documents. The free tier runs in your browser: your file is not uploaded, nothing is stored, and the session ends when you close the tab. Two tools — password-protecting and unlocking a PDF — cannot be done in a browser and send your file to our server, where it is processed and deleted immediately. Those two pages say so on them.

A paid account stores the documents you choose to save, so that you can come back to them.

Your account

You are responsible for what happens under your account and for keeping your password to yourself. Tell us if you think somebody else has got into it. An account is for one person unless you are on a plan with seats, in which case each seat is one person. You must be at least 13 years old — 16 in the United Kingdom and the European Economic Area — and old enough to enter a contract where you live.

Paying

The paid plan is $9 per month, billed monthly in advance. It renews automatically every month until you cancel, and you can cancel at any time from the account menu — you keep access until the end of the period you have already paid for, and we do not refund part-months. Payment is handled by Stripe; we never see or hold your card details. If a payment fails we will retry it; if it keeps failing the account drops back to the free tier and your saved documents remain available to download.

We will give at least 30 days' notice by email before changing the price of an existing subscription.

Your documents are yours

You keep every right you already had in anything you upload or make here. We do not claim ownership, we do not use your documents to train anything, and we do not look at them except where you have asked us to do something specific with one or where we genuinely have to in order to fix a fault you have reported.

You give us only the permission needed to run the service for you — to store a document so you can open it again, and to show it to the people you have shared it with. That permission ends when you delete the document or close your account.

What is ours

The site, the software behind it, the stencil library and the docubend name and logo belong to us. You may use all of it to do your own work, including commercially and including anything you draw with it — what you make is yours outright. What you may not do is copy the service itself: reselling it, rebuilding it from our output, or extracting the stencil library to ship somewhere else.

What you must not do

Do not use docubend to break the law, to infringe somebody else's rights, to handle material you have no right to handle, or to attack the service or the people using it. Do not try to get around the limits on the free tier by automating it, and do not scrape the site.

If somebody's copyright is being infringed

Tell us at tom@brevardcreek.com. Say what the work is, where on docubend you say it appears, how to reach you, and that you believe in good faith that the use is not authorised. We will look at it, remove anything that should not be there, and close the accounts of anybody who does it repeatedly. If your material was removed and you think that was wrong, write to the same address and say so.

Interruptions and endings

We try to keep this running and we do not promise it will never be down. We may suspend or close an account that is breaking these terms; if we do, we will say why unless we are not allowed to. You can close your account at any time, and you can export your documents before you do.

Liability

The service is provided as it is, without warranties of any kind beyond those the law will not let us exclude — we do not promise it will be uninterrupted, error-free, or fit for any particular purpose you have in mind. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability in any twelve month period is limited to what you paid us in that period. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or anything else that cannot be limited by law.

Keep your own copies. We take nightly backups and we test that they restore, but no online service is a substitute for a copy of an important document somewhere you control.

If something you did with docubend — the material you put through it, or breaking the rules above — lands us with a third party's claim, you will cover what that reasonably costs us.

If we disagree

Email us first at tom@brevardcreek.com and give us 30 days. Almost everything ends there, and it is a great deal faster than the alternative for both of us.

If it does not end there, these terms are governed by the laws of North Carolina, without regard to its conflict-of-laws rules, and any dispute will be heard in the state or federal courts in McDowell County, North Carolina, which we both agree to. Either of us can still bring a claim in small claims court.

Changes

If these terms change materially we will email account holders and update the version at the top. Carrying on using docubend after that means accepting the new version.

Odds and ends

These terms, together with the privacy notice, are the whole agreement between us about docubend. If a court finds one part of them unenforceable, the rest still stands. Not enforcing something once does not mean giving it up. You may not transfer this agreement; we may, if the business is sold or reorganised, and we will tell you if that happens. Nobody other than you and us has rights under it.
